Bad Credit Mortgages and County Court Judgements (CCJs)

A CCJ is a county court judgement, which can be made against a private individual or a company.

If you can't, won't or simply don't pay a bill, and the company or person you subsequently owe money to decides to take action against you, you may well face a CCJ.

How will a county court judgement (CCJ) affect my mortgage?

A county court judgement has a negative impact on your credit record. While some standard mortgage lenders will accept applicants with one, or sometimes two, CCJs against their name, many will reject you outright.

So you will have to approach a bad credit lender for your mortgage. As a general rule, the more CCJs on your credit record, the higher the rate of interest charged on mortgages.

How do I get rid of a county court judgement?

It is best to avoid CCJs by paying your bills in the first place. Setting up direct debits to pay your utilities bills can help. If you do have a CCJ pending, it can be worth consulting Citizen's Advice for help with your individual case. But in general, the process varies depending on how much you owe:
  • If you owe less than £5,000, you will be allocated to the small claims track. An informal hearing will be held - no solicitor's costs can be recovered.
  • If you owe between £5,000 and £15,000, you will be allocated to the fast track. The trial is more formal but likely to last no longer than a day. The amount of costs recoverable is limited.
  • The court will set a fine, which you must pay in order for the CCJ to be 'satisfied'.
  • If you don't pay the fine, then expect a visit from the bailiffs.
  • To find out whether a CCJ has been registered against you, contact the Registry Trust.
  • The Registry Trust Limited 173-175 Cleveland Street London, W1P 5PE.

There is a fee of £4.50 for a postal search of the register for each name and address searched.
