Landlord fined for overcrowded property

A Lincolnshire-based landlord has been reprimanded for housing too many people in a rented property.

Sanjay Patel, of Grantham in Lincolnshire, was hit with a £6,300 fine for housing six people in a rented property rather than the permitted five.

South Kesteven Council prosecuted Patel under the Housing Act and he pleaded guilty to the offence in June.

Council inspectors originally found rules were being broken in July 2014 and a re-inspection in January 2015 also found six occupants living in the property.

Grantham Magistrates Court said the landlord was aware of the offence and had committed it in pursuit of financial gain.

An early guilty plea reduced the fine to £5,773.67.

South Kesteven Council’s business manager for environmental health Anne-Marie Coulthard said this case was a warning to all landlords.

“Landlords provide a good service for their tenants in South Kesteven and those who own homes where multiple tenants live are more than aware of their responsibilities to never overfill their properties,” she said.

“However this case shows that landlords cannot simply ignore orders to not overcrowd their properties and we are pleased magistrates saw it fit to impose this level of fine.

“Our officers will always determinedly ensure housing law is strictly adhered to in rented properties to protect tenants.”
